Bowman ORDINANCE NO. 9527 AN ORDINANCE CLOSING AND ABANDONING A PORTION OF EAST 36TH STREET LOCATED NORTHWEST OF DODDS AVENUE, BETWEEN EAST 34TH STREET AND EAST 37TH STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned a portion of East 36th Street located northwest of Dodds Avenue, between East 34th Street and East 37th Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: East 36th Street, an unopened right-of-way varying in width from 50 to 60 feet, and beginning on the southwest line of East 36th Street 315 feet northwest of the intersection of the southwest line of East 36th Street with the northwest line of Dodds Avenue, thence northwest and southwest some 418 feet with East 36th Street to the southeast line of the Alabama Great Southern Railway right-of-way, thence northeast some 193 feet with said railroad right-of-way to the northwest line of East 36th Street, thence northeast and southeast some 289.38 feet with East 36th Street to the southeast corner of lot 600A, block 8, East Lake Mission Ridge Land Company's Subdivision, as shown by plat of record in plat book 2, page 25, R.O.H.C., thence southwest 60 feet to the northwest corner of lot 590, block 10, said East Lake Mission Ridge Land Company's Subdivision, the point of beginning. Said street separates block 8, said subdivision, from block 9, said subdivision, and part of block 100, East End Land Company's Addition No. 1, as shown by plat of record in plat book 2, page 2, R.O.H.C. Tax Map No. 168B-J-11 and 16. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. A right-of-way for a hammerhead turnaround on East 36th Street is dedicated to and accepted by the City of Chattanooga. 3. The areas reserved for utility easements must be kept free and clear of all structures. 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
